Availability of products


The customer can only purchase the products currently present in the Christmas Shop electronic catalogue, visible online at the address (URL) www.christmasshop.it. If the request formulated through an online order exceeds the quantity available for a given item, Christmas Shop will accept the purchase limited to what is actually available in its virtual warehouse.

It will be the responsibility of the Christmas Shop Customer Service to inform the customer (by telephone or e-mail) whether or not the ordered products will be available in the future. The items selected from those present in the virtual catalog of the Christmasshop.it site can be purchased under the following conditions.

Acceptance of the order / Conclusion of the contract

The purchase of what is requested will be completed through the following phases: By sending the order, the customer sends Christmas Shop a purchase proposal for the selected product or products. Sending the purchase order implies consent (pursuant to art. 10 DL 185/1999) to receive subsequent Christmas Shop communications described below, which are aimed exclusively at the conclusion and execution of the sales contract. Christmas Shop confirms receipt of the order sent by the customer with an e-mail message, with assignment of a 'Customer Order Number' which must be used in any further communication with Christmas Shop. The customer has 24 hours from placing the order online to notify Christmas Shop of its cancellation, by calling no. 081.8075815 or by sending an email to info@christmasshop.it.

In any case, Christmas Shop will verify the actual availability of the requested goods in the warehouse and will communicate by telephone, to the number indicated by the customer, whether the order can be accepted or not. If the order can be accepted and if the customer confirms his intention to proceed with the purchase during the same telephone communication, Christmas Shop will send an e-mail confirming the conclusion of the purchase procedure, containing information concerning the conditions of sale, pursuant to art. 4 Legislative Decree 185/1999. Christmas Shop will then deliver what is requested to the express courier responsible for delivering it to the address indicated. Payment by the customer will be made using the method chosen online at the time of purchase (cash on delivery, bank transfer, electronic payment cards, PayPal circuit).

Right of withdrawal Pursuant to art. 5 Legislative Decree 185/1999


If the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a VAT number in the order form to Christmas Shop), he has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.
To exercise this right, the customer must send Christmas Shop a communication to that effect within 10 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to: Christmas Shop, Via degli Archi,18 80067 Sorrento (Na) or by telegram or fax always sent within the aforementioned term of 10 days and followed by a confirmation sent by registered letter with acknowledgment of receipt within the following 48 hours. Once we have received the aforementioned notice of withdrawal, the Christmas Shop Customer Service will quickly inform the customer of the instructions on how to return the goods, which must take place within the following 48 hours.

The right of withdrawal is in any case subject to the following conditions:

The law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories, etc...); the purchased good must be intact and returned in the original packaging, complete in all its parts (including any documentation and accessory equipment: manuals, transformers, etc...); according to the law, the shipping costs are charged to the customer; the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer; in the event of damage to the goods during transport, Christmas Shop will notify the customer of the incident (within the working day following receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier of his choice and obtain reimbursement of the value of the asset (if insured); in this case, the product will be returned, with shipping costs to be paid by the customer, simultaneously canceling the request for withdrawal; Christmas Shop is not liable in any way for damage or theft/loss of goods returned by uninsured shipments; upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the original internal/external packaging is damaged, Christmas Shop will deduct from the refund due a percentage equal to 10% of the same, as a contribution to the costs of restoring the goods. Without prejudice to any repair costs for ascertained damage to the original packaging, Christmas Shop will refund the customer the full amount already paid, within 14 days from the date of return shipment of the goods. It will be the customer's responsibility to promptly provide the bank details on which to obtain the transfer (Cod. ABI - CAB - Current account of the invoice holder). The right of withdrawal is lost for lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Christmas Shop ascertains:

1) the lack of the original external/internal packaging;
2) the absence of integral elements of the product (accessories, cables, manuals, parts, ...);
3) damage to the product for reasons other than its transport.

In the event of forfeiture of the right of withdrawal, Christmas Shop will return the purchased goods to the sender, charging the shipping costs to the sender.

Warranties


All products sold by Christmas Shop are backed by the manufacturer's official guarantee. To use it, the customer must keep the invoice or delivery note that he will receive together with the purchased products. To locate the nearest assistance centre, you can refer to the Christmas Shop Technical Assistance service.

Waiver


Any right of the customer to compensation for damages or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and/or things caused by goods purchased at the Christmas Shop.

Complaints


Any complaint must be addressed to the Christmas Shop, Via Degli Archi 18, 80067 Sorrento (Naples).

Applicable law


The sales contract between the customer and Christmas Shop is concluded in Italy and governed by Italian law.
